1. Acceptance of Terms

By downloading, installing, or using the PeakX mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms govern your access to and use of the PeakX App ("we", "us", or "our"), including all content, features, and services offered through it.

2. Eligibility

You must be at least 18 years old to use PeakX. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Skydiving is an extreme sport carrying inherent risks. Use of PeakX does not imply endorsement of any jump, dropzone, coach, or event listed on the platform. You assume full responsibility for your own safety decisions.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials confidential
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users or the platform.

4. Jump Logging

PeakX allows you to log personal skydiving jumps, including details such as date, location, altitude, discipline, and notes ("Jump Logs"). You retain ownership of your Jump Log content. By submitting Jump Logs, you grant PeakX a non-exclusive, royalty-free licence to store and display this content within the App for the purpose of providing the service.

Jump Logs are user-generated and are not verified by PeakX. We are not responsible for inaccuracies in logged data. Jump Logs should not be used as an official logbook for licensing or certification purposes unless validated by the relevant authority.

5. Coach Booking

PeakX enables you to discover and book coaching sessions with registered skydiving coaches ("Coaches"). Coaches are independent professionals and are not employees or agents of PeakX. We do not supervise, endorse, or guarantee the quality, safety, or legality of any coaching session.

When booking a Coach through PeakX:

• You enter into a direct agreement with the Coach
• You are responsible for verifying the Coach's credentials and licences
• Cancellation and refund policies are set by the Coach and will be disclosed before booking
• PeakX may facilitate payment processing but is not a party to the coaching contract

We encourage you to review Coach profiles, ratings, and reviews before booking. If you experience issues with a Coach, contact us at support@peakxapp.com and we will investigate in good faith.

6. Dropzone & Event Discovery

PeakX provides a directory of dropzones and skydiving events based on user submissions and publicly available information. Listings are provided for informational purposes only. We do not verify, endorse, or guarantee the accuracy of dropzone or event information.

Dropzone operating hours, prices, and event details may change without notice. Always confirm directly with the dropzone or event organiser before travelling or making plans.

7. User-Generated Content

Users may submit content including jump logs, reviews, photos, and event listings ("User Content"). By submitting User Content, you:

• Confirm you own or have the right to share the content
• Grant PeakX a worldwide, non-exclusive, royalty-free licence to use, display, and distribute the content within the App
• Agree not to submit content that is false, defamatory, illegal, harmful, or infringes third-party rights

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without notice and at our sole discretion.

8. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any regulations
• Submit false, misleading, or fraudulent information
• Harass, threaten, or harm other users
• Attempt to reverse-engineer, scrape, or copy the App's code or content
• Use the App to advertise or solicit without our prior written consent
• Circumvent any security or access controls

9. Disclaimers & Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PEAKX DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PEAKX IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Skydiving involves serious risk of injury or death. Nothing in the App constitutes safety advice. Always follow the guidance of qualified instructors, your dropzone, and the rules of your national governing body.

10. Intellectual Property

All content, design, logos, and software in the App are owned by PeakX or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Termination

We may suspend or terminate your access to the App at any time, for any reason, with or without notice. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates (UAE), without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by binding arbitration administered by the Dubai International Arbitration Centre (DIAC) in accordance with its arbitration rules in force at the time of the dispute. The seat of arbitration shall be Dubai, UAE. The language of arbitration shall be English. The arbitral award shall be final and binding on the parties.

Notwithstanding the above, PeakX reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm. Users in certain jurisdictions may have rights under local consumer protection law that cannot be waived by contract.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
